1. PROMOTION DATES
 
The "Embark on the Journey" promotion is held by Cirque du Soleil Inc. The promotion runs from May 20th, 2002 at 12:01 a.m. EST to June 16, 2002 at 11:59 p.m. EST ("promotion period").
 
2. WHO CAN ENTER
 
This promotion is open to legal residents of Canada and the United States (the 50 states and the District of Columbia only) who have reached the age of majority in the province, territory or state in which they reside at the time they enter the promotion and who have an email address and Internet access prior to learning about this promotion. Employees, agents and representatives of Cirque du Soleil, its subsidiaries, its affiliated companies, its controlling corporations, its advertising or promotion agencies, its sponsors, suppliers of materials, prizes and services related to this promotion, or any other person directly associated with the holding of this promotion, as well as members of their immediate families (father, mother, brothers, sisters, children), their legal or common law spouse, and any persons residing with these employees, representatives and agents are not eligible to participate.
 
3. HOW TO ENTER
 
No purchase necessary. Visit the www.cirquedusoleil.com/journey Internet web site between May 20, 2002 at 12:01 a.m. EST and June 16, 2002 at 11:59 p.m. EST and follow the instructions to access the electronic entry form. To enter the Grand Prize drawing and the Weekly Prize selection, complete the entry form by entering your first and last name, complete address, country, postal code, phone number, age and your e-mail address. Entrants must also provide three different and valid third party e-mail addresses, which addresses will only be used in accordance with paragraph 12. By following these steps, entrants will automatically get one entry and be eligible to win one of the Grand Prizes, subject to paragraph 5. An entry will only be valid if each e-mail address provided belongs to a separate individual and is valid at the time the entrant completes the entry form. There is a limit of one Grand Prize entry per person during the promotion period. A valid entry form gives three Stamps (for the Weekly Prize) to an entrant (see next paragraph).
 
For every such third party e-mail address provided, entrants will automatically get one (1) Stamp in their Cirque du Soleil passport, and each Stamp obtained in a given week is counted towards that entrant's total for the purposes of determining the winner of the Weekly Prize. To obtain additional Stamps, entrants must complete one or more "refer a friend" forms and one or more different and valid third party e-mail addresses, which addresses will only be used in accordance with paragraph 12.   No Stamp will be provided unless each e-mail address belongs to a separate individual and is valid at the time the entrant completes the refer a friend form. No Stamp will be provided for an e-mail address provided more than once (in the entry form or refer a friend form) by an entrant during the promotion period.  There is no limit on the number of Stamps any person can accumulate, subject to a maximum of three Stamps per refer a friend form completed.
 
An entrant must, at all times use the same e-mail address.  The use of more than one e-mail address by an individual will result in automatic disqualification of that individual.
 
4. PRIZES
 
Two (2) Grand Prizes will be awarded, each consisting of:
  • 2 VIP Tickets to see the Cirque du Soleil show Varekai (the "Show") anywhere in North America at the winner's choice;
  • round trip economy airfare for two from an international airport close to the winner's place of residence in Canada or the United States;
  • three nights accommodation for two in a hotel to be determined by Cirque du Soleil;
  • the Tapis Rouge experience (VIP tent on site);
  • a special backstage tour of the Show at the winner's selected destination.
 
The following conditions apply to each Grand Prizes:
  • Unless explicitly included in the Grand Prize description above, all costs, charges or expenses, including without limitation all transportation to and from the international airport close to the Grand Prize winner's place of residence, ground transportation, departure tax, insurance, fuel surcharges, travel related fees and items of a personal nature, passports, meals, beverages, bar and wine charges, room service, gratuities and local and long distance telephone calls, are the sole responsibility of the Grand Prize winner or his or her guest. Grand Prize winner and his or her guest must travel together;
  • the prize may only be used for the Show in North America;
  • the prize cannot be used for the Show's "premieres";
  • the prize may apply to any Show between August 2nd 2002 and August 1st, 2003;
  • tickets for the show are subject to availability and seats shall be determined at the sole discretion of Cirque du Soleil;
  • travel arrangements shall be made by Cirque du Soleil. The Grand Prize winner shall notify Cirque du Soleil of his or her selected destination for the Show no later than March 1st, 2003 and at least four weeks prior to the departure date. The Grand Prize winner acknowledges that the departure date and selected destination for the Show cannot be changed once travel and ticket reservations have been made by the Cirque du Soleil.
 
Estimated retail value of each Grand Prize is approximately $5,000.00 (Canadian) and may vary depending on the point of departure. However, no compensation will be awarded if the actual total value of the prize is less.
 
Four (4) Weekly Prizes will be awarded, each consisting of a Cirque du Soleil presents Alegría DVD, of an approximate retail value of $45.00 (Canadian) each.
 
5. GRAND PRIZES DRAW
 
GRAND PRIZES: On June 17, 2002, at 2 p.m. EST at the Montreal office of Cirque du Soleil, two (2) eligible entry forms will be drawn as follows:
  • One (1) eligible entry form will be drawn at random among all eligible entry forms of entrants who were members of Cirque Club before May 19 at 11:59 p.m. EST and who entered the promotion as described in paragraph 3;
  • One (1) eligible entry form will be drawn at random among all eligible entry forms of entrants who entered the promotion as described in paragraph 3, excluding the entrants mentioned in paragraph 5A) above. 
Grand Prize winners will be notified by e-mail within two (2) business days of the drawing. There is a limit of one Grand Prize per person and per domicile or household.
 
6. WEEKLY PRIZES ALLOTMENT
 
WEEKLY PRIZES: A total of four (4) Weekly Prizes will be awarded (except as provided in this paragraph). The entrant who accumulates the most Stamps during each week (from Monday to Sunday) of the promotion period will be selected as the Weekly Prize winner for that week. In the event of a tie for the most Stamps in a given week, promotion organizers will award a Weekly Prize to each of the tied entrants, subject to paragraph 7.

  • On Monday June 3, 2002 at 9 a.m. EST May 27, 2002 to June 2, 2002 at 11:59 p.m. EST
  • On Monday June 10, 2002 at 9 a.m. EST June 3, 2002 to June 9, 2002 at 11:59 p.m. EST
  • On Monday June 17, 2002 at 9 a.m. EST June 10, 2002 to June 16, 2002 at 11:59 p.m. EST
 
Weekly Prize winners will be contacted by e-mail within two (2) business days of winner selection. There is a limit of one Weekly Prize per person during the promotion period.
 

7.  ODDS OF WINNING
 
Odds of winning one of the Grand Prizes depend on the number of eligible entry forms registered by: A) Members of Cirque Club before May 19, 2002 at 11:59 p.m. EST; or B) all other entrants excluding Members of Cirque Club before May 19, 2002 at 11:59 p.m. EST.
 
Chances of winning a Weekly Prize depend on the number of valid Stamps obtained by an entrant each week during the promotion period and the maximum number of valid Stamps obtained by any other entrant.
 
8. WINNER NOTIFICATION AND QUALIFICATION, AND SELECTION OF ALTERNATE WINNERS
 
In order to be declared a prize winner, the entrants selected pursuant to paragraphs 5 and 6 above must meet the following conditions:
  • For residents of Canada only. Selected entrants must, unaided, correctly answer a time-limited mathematical skill-testing question that will be asked by e-mail within two business (2) days following the Grand Prize draws or Weekly Prize selection. Selected entrants must correctly answer the mathematical skill-testing question and reply in accordance with given instructions on the e-mail within two (2) business days following the receipt of the e-mail in his or her mail box;
  • Selected entrants must complete and return to Cirque du Soleil, within ten (10) days from receipt, an affidavit or other document of eligibility, liability/publicity release and compliance with these Official Promotion Rules, confirming his or her compliance with the promotion rules and regulations, releasing Cirque du Soleil and its directors, officers, employees, subsidiaries, affiliated companies, parent companies and agents from all liability, and permitting Cirque du Soleil  and its representatives to use the selected entrant's name, photograph, likeness, statement concerning the prize, place of residence and (or) voice, without compensation, in any publicity carried out by Cirque du Soleil.  Winners may be required to furnish photographic identification in the form of a government-issued document.
 
All federal, state, provincial and/or local taxes are the sole responsibility of the winner.
 
Failure of an entrant to meet any of the above-mentioned conditions will result in the entrant's automatic disqualification and loss of entitlement to his or her prize. In such event, Cirque du Soleil shall have the right to draw or select another entrant as described in paragraphs 5 and 6 until a winner has been determined and qualified.
 
9. PRIZE DELIVERY
 
Weekly Prize winners will receive their prize by mail at Cirque du Soleil's sole cost and expense, within two (2) to four (4) weeks after receipt of the waiver of liability by the promotion organizers. Cirque du Soleil shall be released and discharged from any liability or responsibility in this regard. Grand Prize winners will be informed on how to take possession of their prize and make necessary reservations.
 
10. LIMITS OF LIABILITY
 
PROMOTION ORGANIZERS HAVE NO, AND HEREBY DISCLAIM ALL RESPONSIBILITY AND/OR LIABILITY WHATSOEVER FOR INJURIES, LOSSES, OR DAMAGES OF ANY KIND THAT RESULT FROM ACCEPTANCE, POSSESSION, OR USE OF ANY PRIZE OR FROM ENTRY OR ATTEMPTED ENTRY INTO THE PROMOTION.  PROMOTION ORGANIZERS ASSUME NO LIABILITY FOR LOST OR MISDIRECTED ENTRIES, WHETHER DUE TO TECHNICAL OR COMPUTER MALFUNCTIONS OR OTHERWISE, OR ANY OTHER TECHNICAL OR COMPUTER  MALFUNCTIONS, FRAUD, OR OTHER ERRORS.  PROMOTION ORGANIZERS ASSUME NO LIABILITY FOR TECHNICAL OR COMPUTER MALFUNCTIONS OF ANY KIND.  CIRQUE DU SOLEIL RESERVES THE RIGHT TO CANCEL THE PROMOTION AT ANY TIME IF THE WEB SITE IS INFECTED BY A VIRUS, THE WEBSITE IS HACKED OR THE INTEGRITY OF THE PROMOTION IS COMPRISED IN ANY WAY (Subject to the approval (for Quebec resident only) of the Régie des alcools, des courses et des jeux du Québec).
 
11. GENERAL CONDITIONS
 
Entrants, by entering this promotion, agree to abide by these rules and regulations, and that the decisions of the promotion organizers are final with respect to all aspects of the promotion. All entry forms entered become the property of Cirque du Soleil and will not be returned.
 
The electronic entry forms, refer a friend form or Stamps are subject to audit by the promotion organizers. Any incomplete or fraudulent entry form, refer a friend form or Stamp, or one that is sent late will automatically be rejected and will not be eligible for a prize. In such a case, the organizers' decision will be final. Entrants who have not provided three valid and different e-mail address in their entry forms will not be entered in the promotion.
 
Prizes must be accepted as described in these rules, and may not be sold, transferred to another person, assigned, substituted for another prize, or exchanged in whole or in part for cash. The promotion organizers may be temporarily relieved of their obligations hereunder to the extent that Show performance is delayed or prevented by any cause beyond their reasonable control, including without limitation, acts of God, public enemies, war, civil disorder, fire, flood, explosion, labor disputes or strikes or any acts or orders of any governmental authority.
 
The promotion organizers reserve the right, at their sole discretion, to cancel, terminate or suspend this promotion in its entirety, in the event that a virus, software bug, or unauthorized human intervention occurs, or for any other cause beyond the organizers' control that could compromise or affect the administration, security, impartiality or normal operation of the promotion, subject to the approval (for Quebec residents only) of the Régie des alcools, des courses et des jeux du Québec.
 
For the purpose of these rules, the entrant is the person whose name appears on the electronic entry form and in case of confusion, who owns the e-mail address.  Where applicable, this is the person to whom the skill testing question will be asked and the prize given.
 
There will be no communication with entrants, other than with the persons selected and/or officially declared the winners.
 

12. E-MAIL ADDRESS RETENTION RULES FOR PROMOTIONS
 
The entrant's e-mail address will be entered in the promotion database and Cirque du Soleil will use it to contact the entrant for the purposes of the promotion. No other use will be made of this e-mail address.
 
The addresses that are referred by an entrant will be entered in the promotion database, and the address will be linked to the referrer. If the referred person chooses not to participate in the promotion, Cirque du Soleil will not use the e-mail address for any other purpose.
 
If the entrant chooses to register to Cirque Club while participating in the promotion, that entrant's e-mail address will also be entered in the Cirque Club database. The use of the e-mail address for Cirque Club is described in the terms and conditions and the privacy policy of Cirque Club.
 
At the end of the promotion, when and as permitted by law, all e-mail addresses in the promotion database will be purged.

14. DISPUTES, CHOICE OF LAW, AND CHOICE OF LANGUAGE
 
As a condition to participating in this promotion, each entrant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with this promotion shall be resolved individually, without resort to any form of class action, exclusively before a court located in the Montreal, Quebec having  competent jurisdiction, which court shall apply the laws of the Province of Quebec, without regard to the conflicts of laws principles thereof.  The entrant and the Cirque du Soleil hereby waive any and all right to trial by jury.
 
For Quebec (Canada) residents. Any litigation respecting the conduct or organization of a publicity promotion may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
 
In the event of a discrepancy between the French and English versions of these rules, the English version will prevail.
